Terms and conditions

These Terms of Use govern access to and use of the smartphone mobile application called La Tramontana available on Google Play and the App Store (the “Mobile App”), as well as the website hosted under the domain www.peruviansonco.com (“Website”), as well as the content and services that the Website and the Mobile App make available to its users (the “Users”).

In compliance with article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, the following identifying data of the owner of the Website are provided:

Access to the Website and the Mobile App or their use by the User necessarily implies, and without reservation, knowledge and acceptance of these Conditions of Use. Therefore, it is recommended that the User read them carefully each time they want to access the Website or enter the Mobile App.

USE OF THE WEBSITE AND MOBILE APP

Users shall be entirely responsible for the correct use of the Website and the Mobile App in compliance with current legislation, whether national or international, as well as the principles of good faith, morality, good customs and public order, and with the commitment to diligently observe any additional instructions that may be given to them by PERUVIAN SONCO S.L.

Users shall refrain from using the services and content of the Website for illegal purposes or effects that are harmful to the rights and interests of third parties, or that in any way may damage, render useless, affect or impair the operation of the Website and the Mobile App, its contents and its services. Likewise, it is prohibited to prevent the normal use or enjoyment of the Website and Mobile App by other Users.

Our antivirus system is reasonably secure. For all these reasons, PERUVIAN SONCO S.L. PERUVIAN SONCO S.L. is not responsible for any potential damage or errors that, due to the presence of any virus, may be suffered by the computer system (hardware or software) of the Users when they access or use the Website and Mobile App.

RESPONSIBILITY OF PERUVIAN SONCO S.L.

PERUVIAN SONCO S.L. will make reasonable efforts available to the User to ensure that the content and services included in the Website and Mobile App are accurate and up to date. However, PERUVIAN SONCO S.L. is not in a position to guarantee this circumstance at all times. Likewise, PERUVIAN SONCO S.L. will not be responsible for the operation of the communication networks that enable the operation of the Website and Mobile App, whether fixed or mobile, the responsibility for which lies entirely with providers other than PERUVIAN SONCO S.L..

If it deems it appropriate, PERUVIAN SONCO S.L. PERUVIAN SONCO S.L. may immediately suspend the provision of the service and, where appropriate, remove any content it deems incorrect or illegal, either at its sole discretion or at the request of an affected third party or competent authority, without such suspension giving rise to any compensation.

LINKS TO THIRD PARTIES

PERUVIAN SONCO S.L. assumes no liability arising from the links that enable the User to access services and benefits offered by third parties through the Website and Mobile App, provided that they are not related to the Website and Mobile App. Therefore, PERUVIAN SONCO S.L. is not responsible for the information contained therein or for any effects that may arise from said information. Likewise, PERUVIAN SONCO S.L. reserves the right to withdraw, unilaterally and without prior notice, the links that appear on the Website and Mobile App.

INTELLECTUAL AND INDUSTRIAL PROPERTY

PERUVIAN SONCO S.L. is the owner or licensee of all intellectual and industrial property rights included in the Website and Mobile App, as well as the content accessible through them.

The intellectual property rights of the Website and Mobile App, as well as the texts, images, graphic design, navigation structure, information and content contained therein are the property of PERUVIAN SONCO S.L. , who has the exclusive right to exploit them in any way and, in particular, the rights of reproduction, distribution, public communication and transformation, in accordance with Spanish law  wave of intellectual and industrial property rights.

Authorization of the User to access the Website and Mobile App does not imply a waiver, transfer, license or total or partial assignment of intellectual or industrial property rights by PERUVIAN SONCO S.L., and therefore its use is strictly prohibited.

 

MODIFICATIONS TO THE CONDITIONS OF USE

 

PERUVIAN SONCO S.L. reserves the right to modify these Conditions of Use in accordance with the applicable legislation at any time, which will be duly reported on the Website and Mobile App, and therefore recommends that the User review them periodically to be informed of how PERUVIAN SONCO S.L. protects their information.

APPLICABLE LAW AND JURISDICTION

 

These Conditions of Use are subject to Spanish law.

For the resolution of any conflict that may arise from access to the Website and Mobile App, the User and PERUVIAN SONCO S.L. expressly agree to submit to the courts and tribunals of the city of Madrid, waiving any other general or special jurisdiction that may apply to them.
